Terms & Conditions for making online Payment :

The following terms and conditions ("Terms") apply to all Users of the https://cmccuttack.in Website ("the Portal") and to all services provided through this Website by Cuttack Municipal Corporation (CMC) Limited ("CMC", "we" or "us"). By using the Website, User will be deemed to agree to these Terms & Conditions. If the User does not agree to be bound by these Terms & Conditions, he / she must stop accessing and using CMC Website immediately.

1.    Services Offered:

   CMC is offering the facility of e-Payment Gateway for its users to transfer funds to CMC for booking of community halls (Kalyan Mandap, Sahid Bhawan & Town Hall).

2.   Definitions:

   2.1.   Online Reference No means the reference number allotted by CMC at the time of booking.

   2.2   Receipt Number means the receipt number allotted by CMC at the time of booking.

   2.3   Online Transaction Number means the number allotted by CMC at the time of booking.

   2.4   OTP means the One Time Password received by the user through SMS on his/her registered mobile & number from the CMC Server.

3.   General:

   2.5   CMC Website is Secure Socket Layer (SSL) secured and details of the User will travel on the Internet in a fully encrypted (256 bit, browser independent encryption) form. To ensure security, the details are kept confidential and User’s bank credentials are NOT stored in CMC Portal. CMC makes no guarantee that this service will be uninterrupted, error-free.

   2.6   CMC is not directly involved in the online payment but through service provider i.e., BillDesk of UCO Bank.

   2.7   CMC shall not be liable for any failure by the User or third party making payment of Fees to properly protect data from being seen on their screen by other persons or otherwise obtained by such persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process.

   2.8   This e-Payment facility is subject to realization of amount and the service charges (including Service Tax etc.) from concerned Bank through the Payment Gateway. User will be responsible for all charges, fees, duties, taxes and assessments arising out of using CMC Portal.

   2.9   Server Slow Down / Session Timeout : In case the Website or Payment Service Provider’s webpage, that is linked to the Website, is experiencing any server related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his / her bank account has been debited or not and accordingly resort to one of the following options :

a. In case the Bank Account appears to be debited, ensure that he / she does not make the payment twice and contact CMC.

b. In case the Bank Account is not debited, the User may initiate a fresh transaction to make payment.

   2.10   Earnest efforts will be made to keep the portal available 24x7. However, CMC is not responsible for delay in processing on account of the multiplicity of organizations involved in online transactions, the problems with currently available Internet infrastructure and working days/holidays of financial institutions.

   2.11   User will be responsible for maintaining the confidentiality of the OTP and is fully responsible for all activities that occur under his / her account. User will be solely responsible for any unauthorized use of his / her OTP or account or any other breach of security. CMC will not be liable for any financial loss or damage arising from his / her failure to comply with this.

   2.12   The portal provides banking transactions over Credit Card, Debit Card, Net Banking only. Please ensure that all details are correct before proceeding with the Bank transactions over the portal to avoid errors.

   2.13   All content in the portal is owned by CMC and is the copyrighted work of CMC and is protected by appropriate laws.

   2.14   CMC reserves the right to modify & update the portal and Terms & Conditions whenever required. The registered Users shall be bound by these modified/updated portal and Terms & Conditions.

   2.15   The transaction amount shall be credited in the User’s wallet to be utilized against booking of Community Centre of CMC.

   2.16   Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by the User, CMC does not represent or guarantee that the use of the Services provided by / through it will not result in the theft and / or unauthorized use of data over the Internet.

   2.17   The User agrees that the net banking / Card details provided by him / her for use of the aforesaid service(s) must be correct and accurate and that the User shall not use a net banking / card that is not lawfully owned by him / her or the use of which is not authorized by the lawful owner thereof. The User further agrees and undertakes to provide correct and valid net banking details.

   2.18   The User is responsible to ensure sufficient credit is available on the nominated bank account at the time of making the payment to permit the payment payable by the User inclusive of the applicable charges

   2.19   CMC has made this service available to the User as a matter of convenience. CMC expressly disclaims any claim or liability arising out of the provision of this service. The User agrees and acknowledges that he / she shall be solely responsible for his / her conduct and that CMC reserves the right to terminate the rights to use of the service immediately without giving any prior notice thereof.

4.   Transaction Reference:

   4.1   The User can save/take a printout of the electronically generated receipt & preserve them for future reference.

5.   Refunds:

   5.1   In case where refund is claimed, the User will make request to CMC for the same showing ample justification. In such cases, the refund will be considered by CMC on case to case basis as per rule.

   5.2   For any incomplete transaction, where CMC account is not credited, User should contact his or her respective Bank.

6.   Grievances redressal:

   6.1   All grievance redressal will happen in consultation with the respective Bank, and the User.

   6.2   All communications on the Grievance redressal will be addressed to the User through the Authorized Representative of CMC.

7.   SMS:

   7.1   User must provide his / her valid Mobile No and accept that it is correct and presently in his/her use.

   7.2   User must accept to receive the OTP, payment confirmation and related SMS from CMC and confirm not make any complaint in this regard to any regulatory authority.

8.   Exclusion of Liability:

      CMC will not be liable for any loss or damage arising out of negligence of the User in use of CMC Portal such as loss of revenue, business, anticipated savings or profits or any indirect or consequential loss. CMC will also not be liable for any loss of income or revenue due to consequence of downtime or any other inactivity or inoperability of the portal.

9.   Obligations of the User:

   9.1   The Portal shall be used only for lawful purposes and the User shall be responsible for complying with all applicable State laws, statutes and regulations in all disputes arising out of or relating to the use of the portal.

   9.2   User should not modify copy, distribute, display, reproduce, publish, license, any information, obtained from this Portal. User shall not create a hypertext link to the Portal, Reverse engineer and attempt to discover the source code.

   9.3   CMC reserves the right to disclose any information as it deems necessary to any applicable Central/State Governmental Authorities under applicable laws, regulations, and upon receiving such request from them.

   9.4   The User shall comply with all reasonable directions issued by CMC relating to the e-Payment Gateway; comply with all security standards as set out by CMC.

   9.5   User shall accept that he / she has the power and authority to accept these Terms and Conditions.

   9.6   User is capable of assuming, and do assume, any risks related to the use of the contents in this Portal.

10.   Force Majeure:

      CMC shall not be liable to the User in respect of any delay in performance of these terms and conditions or delay in performance or breach of the terms and conditions due to any event or circumstances beyond its reasonable control.

11.   Disclaimer:

      CMC is not responsible for wrong receipts raised due to incorrect filling of details and also for the financial or other loss incurred consequently.
